Failed atos medical

Postby Bebbe » Fri Jun 01, 2012 4:15 pm

Hi everyone, I'm looking for a bit advise I rang my job centre today and have found out that I did not pass my medical the lady on the phone said if I wish to appeal I will have to wait for the letter confirming I did not pass and also send a sick note (appointment for doctor next sat). I was wondering if any one has went through the appeal process if you can tell me how it works and what I should do. Just my luck for it to happen over the long weekend :(

This linky should help Bebbe. Sorry you've had one of their daft decision makers, unfortunately they outnumber the sensible ones by about a million to one

Hi everyone I am new to this but thought I'd let you know my experience of atos medical, which I had in march and just received the 'official' letter today.I scored no points, even though I have fibromyalgia, psoriatic arthritis, degenerated disc disease, nerve entrapment, asthma, also carpel tunnel, underactive thyroid and high cholesterol.I found that the 'nurse' who did my medical tried to 'befriend' me,but when I received my report she lied over and over again and twisted everything I said,I received a phone call about 3 weeks ago from dwp informing me I had not received any points and therefore fit for work,I got the impression that she was on my side and believed everything I said, however in her report today I have found out my esa was stopped on 14th may, after reading other peoples experience on this and tribunals I feel as if I have no alternative but to return to my job{ even though I am on the waiting list for 2 operations at different hospitals} because from what i have heard the dwp hound you if you're successful and win your appeal, they keep on sending you for medicals every couple of months,I don't think I can stand the stress.

:welcome: to the forum rosepompom   Sorry to hear you've become another of Atos's victims. The tricks and scheming you experienced are similar to what a lot of us have also gone thru with them    Rather than finding yourself forced back into a job you know will be difficult for you, you have the appeal option available.

If you decide to go for it, you need to let them know in writing within 30 days of your notification of fate from them. When they have your notification of appeal, payments at the assessment level should be reinstated and carry on until you have gone thru the appeal process. The linky I posted at the start of this topic gives you the detailed info you need to start and go thru the system.

:goodluck2: :goodluck2: with whatever you decide to do, please consider all your options tho, things may not be quite as bleak as they initially seem.

Hi everyone, Thanks for the replies. I got my letter today with the health care specialists report she has twisted everything that I said in the interview as she asked me if I do any house work and I replied no but she kept asking about house work until I replied I could hoover on a very good day and maybe fill the washer but not empty it which does not happen often, on the report it sounds as if I hoover every day fill the washer and because I was able to stand for 2 minutes with out pain even though my pain starts after about 10 minutes when standing then I have been deemed fit for work.( All this stress has brought on my anxiety I feel sick with worry)
Any way I have a contact number for a lady at disability north my cousin has seen her a few times for tribunals and has won, she fills all the necessary forms for you and attends the tribunals with you and speaks on your behalf.

Just some information I hope will be helpful. When making an appeal against the decision remember to state on the appeal form that you wish your benefit to continue, if you don't they won't pay you. You will be on cut money until your appeal if you win then you will get your full money reinstated and they will only back date your money up to 4 months.

My case has been looked at again and the DWP did not change their minds so its going to a tribunal which I should have a date in the next 2 weeks :yikes: This is really not helping my anxiety which according to my medicals I don't have.
